Sean Penn is the guest on this latest episode of Zach Galifianakis excruciation-fest Between Two Ferns; this time, however, the show is hosted by Zach’s twin brother Seth, who is a totally different person, as Zach is at “adult fat camp.”

He was pushed to his edge after a run-in with a paparazzo, and now Sean Penn is being sued by a photog.

Apparently, last year when it happened, Jordan Dawes was filming a documentary about paparazzi in Brentwood, CA when Mr Penn suddenly began “kicking and punching” him.

Sean Penn will be charged with criminal battery and vandalism today, in connection with a run-in with the paparazzi ... TMZ has learned.



The incident occurred last October in Brentwood, CA. TMZ captured the confrontation as an angry Penn approached and kicked a paparazzo, allegedly breaking his camera.

We've learned the Los Angeles City Attorney will file two misdemeanor counts later today -- battery and vandalism.

If convicted on both counts, Penn could go to jail for 1 1/2 years.

Penn's rep could not immediately be reached for comment.
